About Imprisonment and Fines

The most common question we get when a client comes to us is, “Will I have to go to jail?” While we do everything possible to get the charges against you dismissed or reduced, it’s important to understand some basic information about state criminal charges and penalties in Illinois. Criminal charges are largely divided into two categories based on the severity of the crime and how much jail time and fines are assessed if someone is found guilty. For instance, a theft can be a misdemeanor or a felony, depending on the value of the item allegedly stolen. Crimes can also be State or Federal offenses:

  • Misdemeanors are crimes penalized with a fine and a potential sentence of up to one year in the county jail.
  • Felonies are crimes penalized with a fine and a potential sentence of one year or more in the Illinois Department of Corrections.
  • Federal crimes include misdemeanors or felonies that violate U.S. laws and are often investigated by federal agencies such as the IRS, FBI, ATF, etc. Sentences are governed by mandatory minimums (set by federal statute) and sentencing guidelines, which take into consideration the specific characteristics of the criminal offense to establish a base offense level and the defendant’s criminal history to establish a sentencing guideline range in terms of months.
